Qualifying Requirements

Admission to the Panel of Arbitrators

A member who seeks to be admitted to the LSAS Panel of Arbitrators must satisfy the following requirements:

  • he has been in practice as an Advocate and Solicitor (as defined in the Legal Profession Act) for a period of not less than 15 years in aggregate; and
  • he must provide undertakings, namely, to act as an arbitrator if appointed by the Society at the scale of fees as determined by the Law Society from time to time and (subject to the relevant consents and undertakings) to permit persons nominated by the Alternative Dispute Resolution Committee to understudy him, to attend the arbitration hearings conducted by him, and to provide such instructions as he deems suitable; and
  • he must satisfy the following requirements:
    • he is a Fellow of the Singapore Institute of Arbitrators (SIArb) or Chartered Institute of Arbitrators (CIArb); and
    • he has acted as an arbitrator and has written at least two reasoned awards.

Admission to the Panel of Mediators

The LSMS shall comprise a Panel of Mediators consisting of 2 categories of mediators, namely:

  • Senior Mediators; and
  • Associate Mediators

Mediators appointed to the Panel of Mediators shall, at all material times, have in force a valid practising certificate. The LSMS retains the right to remove from the panel any mediator who does not have a valid practising certificate during the tenure of his/her appointment.

Appointment of Senior Mediators

For appointment of Senior Mediators, the Selections Committee may consider applicants who possess the following qualifying requirements:

  • an Advocate and Solicitor of the Supreme Court of Singapore with a minimum aggregate of 15 years PQE and who holds a valid practising certificate; and
  • a SIMI Certified Mediator or a Principal Mediator or equivalent level of a designated mediation service provider1 or an incumbent Senior Mediator on the Panel of Mediators; and/or
  • in relation to the level of mediation experience achieved —
    • has at least 5 years of experience as a mediator since accreditation, and has mediated at least 20 cases in the last 7 years preceding the application; or
    • has at least 5 years of experience as a mediator since accreditation, and has obtained other forms of mediation experience as may be acceptable to the Selections Committee.

Appointment of Associate Mediators

For appointment of Associate Mediators, the Selections Committee may consider applicants who possess the following qualifying requirements:

  • an Advocate and Solicitor of the Supreme Court of Singapore with a minimum aggregate of 5 years PQE and who holds a valid practising certificate; and
  • a mediator who —
    • is accredited by a designated mediation service provider1;
    • has attained at least SIMI Accredited Mediator Level 1; or
    • has undergone such other mediation training as may be acceptable to the Selections Committee.

1In accordance with the Mediation Act 2017, the designated mediation service providers are the Singapore International Mediation Centre, Singapore Mediation Centre, Tripartite Alliance for Dispute Management, and World Intellectual Property Organization Arbitration and Mediation Center.

Admission to the Panel of Neutrals

A member who seeks to be admitted to the LSNEDS Panel of Neutrals must satisfy the following requirements:

  • he has been in practice as an Advocate and Solicitor (as defined in the Legal Profession Act) for a period of not less than 15 years in aggregate; and
  • he must provide undertakings, namely, to act as a neutral if appointed by the Law Society at the scale of fees as determined by the Law Society from time to time; and

  • he must satisfy the following requirements:
    • he has acted as an adjudicator and/or arbitrator and/or neutral; and
    • he has written and/or assisted in writing at least 2 reasoned awards and/or adjudication determinations and/or neutral evaluations and/or neutral determinations.
